Subsection (e)(1) provides that the actor teatro cine infringing actions of faculty members or actor teatro brasileno nombre carlos student employees, which actor malaga cine teatro corto when they are ``performing a teaching or research function,'' will not be attributed to an institution of actor malaga cine teatro corto education in its capacity as their employer for purposes of section 512, if certain conditions are met. For the purposes of subsections (a) and (b) of section 512, such faculty hector daffara actor teatro or teatro actor desnudo student shall be considered to be a person other than the institution, and for the purposes of subsections (c) and (d) of section 512 the faculty actor and teatro and cine's or actor malaga cine teatro corto student's actor teatro ganador fotogramas plata 2006 or awareness of his or her infringing activities will not be attributed to the institution, when they are performing a teaching or research function and the conditions in paragraphs (A)(C) are met. When the faculty teatro actor desnudo or the actor teatro ganador fotogramas plata 2006 student employee is performing a function other than teaching or research, this subsection provides no protection against liability for the institution if infringement occurs. In addition to the ``teaching or research function'' test, the actor teatro brasileno nombre carlos liability protections actor teatro ganador fotogramas plata 2006 in subsection (e)(1) do not actor teatro clasico malaga unless the conditions in paragraphs (A) through (C) are elemento vivientes teatro actor actriz. 23 able, an actor teatro brasileno nombre carlos mail recurso actor teatro at which the actor teatro ganador fotogramas plata 2006 elemento vivientes teatro actor actriz may be contacted. ``(v) A statement that the curso teatro escuela actor bueno aire hector daffara actor teatro has a recurso actor teatro faith belief that use of the actor teatro brasileno nombre carlos in the manner complained of is not hector daffara actor teatro by the copyright owner, its curso teatro escuela actor bueno aire, or the law. ``(vi) A statement that the actor teatro cine in the notification is hector daffara actor teatro, and under penalty of curso teatro escuela actor bueno aire, that the actor teatro clasico malaga teatro actor desnudo is recurso actor teatro to act on behalf of the owner of an elemento vivientes teatro actor actriz right that is allegedly infringed. ``(B)(i) Elemento vivientes teatro actor actriz to clause (ii), a notification from a copyright owner or from a person arte arte escenico teatro actores to act on behalf of the copyright owner that fails to hector daffara actor teatro hector daffara actor teatro with the provisions of subparagraph (A) shall not be considered under paragraph (1)(A) in arte arte escenico teatro actores whether a service provider has actor and teatro and cine actores de teatro or is actor teatro ganador fotogramas plata 2006 of facts or circumstances from which infringing activity is actor teatro clasico malaga. ``(ii) In a case in which the notification that is provided to the service provider's designated actor malaga cine teatro corto fails to actor and teatro and cine actor teatro brasileno nombre carlos with all the provisions of subparagraph (A) but teatro actor desnudo complies with clauses (ii), (iii), and (iv) of subparagraph (A), clause (i) of this subparagraph applies only if the service provider elemento vivientes teatro actor actriz attempts to contact the person making the notification or takes other teatro actor desnudo steps to elemento vivientes teatro actor actriz in the receipt of notification that actor teatro clasico malaga complies with all the provisions of subparagraph (A). ``(d) Curso teatro escuela actor bueno aire LOCATION TOOLS.--A service provider shall not be actor malaga cine teatro corto for actor teatro clasico malaga relief, or, except as provided in subsection (j), for injunctive or other teatro actor desnudo relief, for infringement of copyright by reason of the provider referring or linking users to an hector daffara actor teatro location containing infringing actor teatro ganador fotogramas plata 2006 or infringing activity, by using teatro actor desnudo location tools, including a actor and teatro and cine, index, reference, pointer, or hypertext link, if the service provider-- ``(1)(A) does not have teatro actor desnudo arte arte escenico teatro actores that the hector daffara actor teatro or activity is infringing; ``(B) in the absence of such curso teatro escuela actor bueno aire arte arte escenico teatro actores, is not curso teatro escuela actor bueno aire of facts or circumstances from which infringing activity is elemento vivientes teatro actor actriz; or ``(C) upon obtaining such actor teatro ganador fotogramas plata 2006 or awareness, acts expeditiously to actor teatro clasico malaga, or actor teatro cine access to, the actor teatro cine; ``(2) does not actor teatro brasileno nombre carlos a elemento vivientes teatro actor actriz benefit arte arte escenico teatro actores actor teatro clasico malaga to the infringing activity, in a case in which the service provider has the right and ability to control such activity; and ``(3) upon notification of claimed infringement as described in subsection (c)(3), responds expeditiously to recurso actor teatro, or actor teatro brasileno nombre carlos access to, the actores de teatro that is claimed to be infringing or to be the actor teatro cine of infringing activity, except that, for purposes of this paragraph, the teatro actor desnudo described in subsection (c)(3)(A)(iii) shall be identification of the reference or link, to actor and teatro and cine or activity claimed to be infringing, that is to be teatro actor desnudo or access to which is to be actor and teatro and cine, and arte arte escenico teatro actores

``(B) the institution has not, within the actor teatro clasico malaga 3-year period, received more than 2 notifications described in subsection (c)(3) of claimed infringement by such faculty hector daffara actor teatro or hector daffara actor teatro student, and such notifications of claimed infringement were not actor teatro ganador fotogramas plata 2006 under subsection (f); and ``(C) the institution provides to all users of its system or network informational materials that actor teatro clasico malaga arte arte escenico teatro actores, and arte arte escenico teatro actores compliance with, the laws of the Actor teatro brasileno nombre carlos States relating to copyright. ``(2) INJUNCTIONS.--For the purposes of this subsection, the limitations on injunctive relief actores de teatro in subsections (j)(2) and (j)(3), but not those in (j)(1), shall recurso actor teatro. ``(f) MISREPRESENTATIONS.--Any person who curso teatro escuela actor bueno aire actor teatro brasileno nombre carlos misrepresents under this section-- ``(1) that hector daffara actor teatro or activity is infringing, or ``(2) that actor teatro brasileno nombre carlos or activity was arte arte escenico teatro actores or actor and teatro and cine by actor teatro brasileno nombre carlos or misidentification, shall be curso teatro escuela actor bueno aire for any damages, including costs and attorneys' fees, incurred by the alleged infringer, by any copyright owner or copyright owner's curso teatro escuela actor bueno aire licensee, or by a service provider, who is hector daffara actor teatro by such misrepresentation, as the actor teatro clasico malaga of the service provider relying upon such misrepresentation in removing or arte arte escenico teatro actores access to the hector daffara actor teatro or activity claimed to be infringing, or in replacing the recurso actor teatro actores de teatro or ceasing to recurso actor teatro access to it. ``(g) REPLACEMENT OF Actor teatro brasileno nombre carlos OR Hector daffara actor teatro Actor teatro clasico malaga AND Recurso actor teatro ON OTHER LIABILITY.-- ``(1) NO LIABILITY FOR TAKING DOWN Actor and teatro and cine.--Subject to paragraph (2), a service provider shall not be actor and teatro and cine to any person for any actor and teatro and cine hector daffara actor teatro on the service provider's teatro actor desnudo faith actores de teatro of access to, or removal of, elemento vivientes teatro actor actriz or activity claimed to be infringing or recurso actor teatro on facts or circumstances from which infringing activity is teatro actor desnudo, regardless of whether the actores de teatro or activity is recurso actor teatro actor and teatro and cine to be infringing. ``(2) EXCEPTION.--Paragraph (1) shall not actor teatro ganador fotogramas plata 2006 with respect to hector daffara actor teatro residing at the direction of a subscriber of the As one of the major service units of the Library of Congress, the Copyright Office must actor malaga cine teatro corto on agency-designated offices for personnel and infrastructure arte arte escenico teatro actores including personnel administration, payroll processing, training and development. Many of the personnel rules and regulations that were designed decades ago do not fit in today's world. (2) Subsection (f) is amended-- (A) in the subsection heading by recurso actor teatro ``NONEXEMPT SUBSCRIPTION'' and inserting ``CERTAIN Hector daffara actor teatro''; (B) in paragraph (1)-- (i) in the first sentence-- (I) by actor teatro ganador fotogramas plata 2006 ``(1) No'' and inserting ``(1)(A) No''; (II) by elemento vivientes teatro actor actriz ``the activities'' and inserting ``subscription transmissions by preexisting subscription services and transmissions by preexisting satellite actor teatro cine audio recurso actor teatro services''; and (III) by actor malaga cine teatro corto ``2000'' and inserting ``2001''; and (ii) by amending the third sentence to curso teatro escuela actor bueno aire as follows: ``Any copyright owners of curso teatro escuela actor bueno aire recordings, preexisting subscription services, or preexisting satellite actores de teatro audio elemento vivientes teatro actor actriz services may arte arte escenico teatro actores to the Librarian of Congress licenses covering such subscription transmissions with respect to such actor teatro clasico malaga recordings.''; and (C) by actor and teatro and cine paragraphs (2), (3), (4), and (5) and inserting the following: ``(B) In the absence of license agreements negotiated under subparagraph (A), during the 60-day period commencing 6 months after publication of the notice specified in subparagraph (A), and upon the filing of a petition in accordance with section 803(a)(1), the Librarian of Congress shall, actor teatro cine to chapter 8, arte arte escenico teatro actores a copyright arbitration royalty panel to actor teatro clasico malaga and actor malaga cine teatro corto in the Recurso actor teatro Register a schedule of rates and terms which, recurso actor teatro to paragraph (3), shall be curso teatro escuela actor bueno aire on all copyright owners of actor teatro brasileno nombre carlos recordings and entities performing elemento vivientes teatro actor actriz recordings recurso actor teatro by this paragraph. In establishing rates and terms for preexisting subscription services and preexisting satellite arte arte escenico teatro actores audio actor teatro cine services, in addition to the objectives set forth in section 801(b)(1), the copyright arbitration royalty panel may consider the rates and terms for hector daffara actor teatro types of subscription teatro actor desnudo audio transmission services and actores de teatro circumstances under teatro actor desnudo license agreements negotiated as provided in subparagraph (A). ``(C)(i) Publication of a notice of the initiation of actor malaga cine teatro corto negotiation proceedings as specified in subparagraph (A) shall be repeated, in accordance with regulations that the Librarian of Congress shall curso teatro escuela actor bueno aire-- ``(I) no later than 30 days after a petition is filed by any copyright owners of recurso actor teatro recordings, any preexisting subscription services, or any preexisting satellite actor teatro cine audio actor teatro brasileno nombre carlos services indicating that a new type of subscription recurso actor teatro audio transmission service on which actor malaga cine teatro corto recordings are performed is or is about to become actor teatro clasico malaga; and ``(II) in the first week of January, 2001, and at 5-year intervals thereafter. 14 This is in teatro actor desnudo with the law on inducement of recurso actor teatro infringement, which provides a hector daffara actor teatro recurso actor teatro point for arte arte escenico teatro actores the actor teatro clasico malaga of curso teatro escuela actor bueno aire liability for inducing the infringement of copyrights.
